Detailed Explanation

Anyone can file a criminal complaint with the police or public prosecutor's office. Unlike a criminal application (Strafantrag), the complaint alone does not establish procedural rights. The public prosecutor decides based on the principle of legality pursuant to § 152 StPO whether to initiate investigation proceedings.
