Statute of Limitations

Procedural Law

Definition

The legal consequence that a claim can no longer be enforced after expiration of a legally determined period.

Detailed Explanation

The regular limitation period in German civil law is three years from knowledge of the circumstances giving rise to the claim. Certain actions such as filing a lawsuit or acknowledgment suspend or interrupt the limitation period. After the limitation period expires, the debtor can permanently refuse performance.
